FAQs

Is mediation compulsory before court?2025-08-11T12:19:01+01:00

In most cases, yes. You’ll need to attend a Mediation Information and Assessment Meeting (MIAM) before applying to court, unless there are urgent safeguarding concerns.

Can I take my child abroad after separation?2025-08-11T12:18:47+01:00

Not without the consent of everyone with parental responsibility or permission from the court. If you’re concerned about this, we can help you act quickly.

Do both parents always have parental responsibility?2025-08-11T12:18:33+01:00

Not always. Mothers automatically have it. Fathers may also have it depending on their relationship status or whether they are named on the birth certificate. Parental Responsibility Orders can be applied for where needed.

What is a Child Arrangement Order?2025-08-11T12:18:03+01:00

This is a court order that sets out where your child will live and how they’ll spend time with each parent. It can also cover holidays and special occasions.

What happens if a Child Arrangement Order is breached?2025-08-11T12:18:19+01:00

Breaching the terms of a court order is serious. The court can issue penalties, vary the arrangement or even consider enforcement action.
