Our client, a management and consultancy practice, had been using a standard Terms and Conditions template they had found online. They were looking for an update to those conditions to limit their liability in the event that the advice they provided did not prevent an issue for their client.

The client was referred to us by a local accountancy practice.

How We Helped

Upon receiving the referral, Christopher Buck contacted the client by email to obtain further information about their needs. After receiving an initial outline from the client, further discussions took place to establish background on the client’s business and what the terms and conditions were needed for.

Having obtained this information, Christopher drafted Terms and Conditions for the client that could either be provided to their customers to sign or made accessible on their website. These were emailed to the client alongside an explanation of why the terms were drafted in the way they were, with reference given to the legal reasoning for doing so.

Information was also provided to the client on how best to incorporate the terms and conditions into the contractual relationship with their customers to ensure they minimised any potential risk to themselves.

The Outcome

The new Terms and Conditions will assist the client in their desired outcome of limiting their liability in instances where their customer encounters further issues after the client has provided their services. This could lead to fewer claims being brought against the client or limited liability for any claims that are brought.

Why This Matters

Regular review of a company’s standard Terms and Conditions is necessary to ensure they are in line with current regulations and legislation. Terms and Conditions should also be tailored to the company’s individual situation to ensure that the maximum protection is afforded to them.
